Microsoft Word - List Issue in Word 2003 and 2010

Hi,
I have a application in Word 2003 which works fine and all the list (bullets) are inserted correctly.
however if I try running the same code in 2010 it only works for half of the code.. The bullets are inserted correctly from (a to o) but when it proceeds to insert the bullet (p) it resets the list to start again from (a) even though the command given is to continue numbering.. Please help me with this one :(

The line which gives issue is :

Selection.Range.ListFormat.ApplyListTemplate ListTemplate:=numberTmpl, ContinuePreviousList:=True, ApplyTo:=wdListApplyToThisPointForward

 

Where numbertmpl is set using the below code:

 

      Set temp = ListGalleries(wdNumberGallery).ListTemplates(5)

      With temp.ListLevels(1)

        .NumberFormat = "(%1)"

        .TrailingCharacter = wdTrailingTab

        .NumberStyle = wdListNumberStyleLowercaseLetter

        .NumberPosition = InchesToPoints(0.25)

        .Alignment = wdListLevelAlignLeft

        .TextPosition = InchesToPoints(0.5)

        .TabPosition = InchesToPoints(0.5)

        .ResetOnHigher = 0

        If CSAVOObj.StaticDataRef.bIsAmendment Then

        .StartAt = 1

        End If

        .LinkedStyle = ""

      End With

The same code works when list is applied before but at one point of time in the code the same statement gives a wring output and starts a new list
